Affirmative Asylum

It is a humanitarian protection that the United States government grants to those people who have suffered persecution in their country of origin or have a well-founded fear of suffering persecution in the future by the government or an entity that the government does not can or does not want to control, motivated by 5 protected grounds:

  • Race

  • Nationality

  • Religion

  • Political Opinion

  • Membership in a Particular Social Group

  • It is filed administratively with the Immigration Service and

  • Defensive Asylum:

  • You are applying for asylum as a defense against removal from the United States.

  • Must be in process in the Immigration Court with the Executive Office for Immigration Review (EOIR).

  • People are generally placed in a defensive asylum process in one of two ways:o Were detained in the United Statesor at a United States port of entry without proper legal documents or in violation of your immigration status;o Were stopped by US Customs and Border Protection (CBP) trying to enter the United States without proper documentation, were placed in expedited removal proceedings because an officer The asylum officer determined that the person had a credible fear of persecution or torture in their country of origin.
