Permanent Residence or Adjustment of Status

It is a process by which a person who is in the United States requests their permanent resident status (Green Card or Green Card) without having to return to their country of origin to carry out consular processing.


There are different ways to obtain this benefit, the most common are:

  • Through an immediate US citizen relative or a relative who falls within the preferential categories;

  • If you are the fiancé of a US citizen, you entered the United States on a fiancé visa and were married within 90 days of your entry and admission into the country;

  •  If you are the widow(er) of a US citizen;

  •  If you are a VAWA self-petitioner – Victim of Domestic Violence: abuse or extreme cruelty;

  •  Through a job;

  • - If you are a special immigrant;

  • - If you obtained asylum and/or refugee status;

  • - If you obtained a U nonimmigrant Visa and have continuously resided in the United States for a period of at least 3 years;

  • - Among others.
